After all if i create character i can give it any age i want, and any look, but also, even if they are underage anime characters, no one is exploited, there is no harm, so why are people so frustrated over it i wonder.

You missed the best example... Star Trek: Voyager.

A company I worked for, saw the Japanese manga trend long before others did. However, it just so happened that president Clinton created a new law making "underage" cartoon characters, a federal crime. Our first step was to find an attorney and find out if we could get the material officially reviewed to find out exactly which characters were underage.
The first question was the same one you asked, is it the portrayed age or the appearance or the time in existence?

The answer we got was whichever age the local prosecutor wanted it to be.
Keep in mind this was long before manga got divided into sexual categories; even the business magazines had photographs of topless teen girls in them--certainly, the comics could be construed to contain images of children.
Since none of us wanted to pay to explain manga to a jury in the bible belt (with the potential to go to prison if we failed) we nixed the idea of being one of the first importers of manga!
Also, let's not forget people have gotten insane prison time... just for violating the federal law against a single joint of pot!

Clinton also made certain "stories" (text) illegal. I'm not sure if they had to be a story about underage kids having sex, but I do remember some poor soul was the first to be prosecuted for a story in well over 100 years. It was a female mental patient, if I recall, and she wrote stories about how her father used to abuse her.
I don't write porn/sex/abuse stories of any kind, but as a writer I find it disturbing that laws like that exist in the US.
